Labor and Employment Law Expertise

  • Chairs Gallop's ERISA Litigation and Multiemployer/Taft-Hartley Plans Practice Group.
  • Represents management in a wide variety of industries including construction, manufacturing, consumer goods, banking, and retail services.
  • Experienced in all aspects of labor and employment law, including federal and state court litigation, collective bargaining negotiations, defense of union organizing campaigns, discrmination claims, non-competition and non-solicitation disputes, ERISA litigation and multiemployer pension and welfare plans.
  • Negotiated collective bargaining agreements with the United Steel Workers, the Teamsters, and the Oil and Chemical workers, for separate manufacturing employers in which employees were required, for the first time, to make substantial contributions towards health care premiums.
  • Defended publicly traded companies in disputes over funding deficiencies and withdrawal liability with multiemployer pension plans.
  • Defended employers in federal and state court cases involving claims under Title VII, the Americans with Disabilities Act, the Age Discrimination in Employment Act and ERISA.
  • Drafts restrictive covenants including non-competition, non-solicitation, and nondisclosure agreements and litigates cases regarding restrictive covenants.
  • Counsels businesses in steps to take to avoid employment-related problems and litigation.
  • Drafts numerous employee handbooks and employment policies.
  • Frequent lecturer on labor, employment, and ERISA topics before business groups and trade associations.

Background

Mr. Kafka joined Gallop in 1995. He began his legal career at the National Labor Relations Board where he worked first as a field attorney and later as a trial specialist. Mr. Kafka practiced at another St. Louis law firm for eight years before joining Gallop as the Chair of its Labor and Employment Department.
